The Environmental Control Board was created in 1970 as NYC's administrative tribunal for adjudicating building, health, safety, and environmental code violations. In 2009, ECB was folded into the Office of Administrative Trials and Hearings (OATH) as its own hearing division — which is why these violations are labeled "ECB/OATH" today, even though most people still just call them ECB violations. Summonses come from more than 25 different city enforcement agencies, and citywide, ECB issues well over 100,000 violations a year.
Most ECB violations trace back to one of a handful of causes: work performed without a required DOB permit, failure to maintain an exterior wall or other building element, a permit that expired mid-project, or ignoring a prior correction order until it escalated. Because the violation is adjudicated at an OATH hearing rather than just cleared by an inspector sign-off, correcting the underlying condition and filing the Certificate of Correction are two separate, both-required steps.
