Why sidewalks crack

NYC sidewalks take a beating from things most owners never see happening. Water gets into hairline cracks and freezes through dozens of freeze-thaw cycles each winter — ice expands and widens the crack a little more every time. Tree roots push up from below and heave slabs out of level. Concrete poured decades ago simply reaches the end of its service life, and road salt used for de-icing accelerates surface spalling faster than plain weathering would on its own.

The reason it's your problem to fix: since 2003, NYC Administrative Code §7-210 (Local Law 49 of 2003) shifted sidewalk liability from the City to the property owner. Most owners are now strictly liable for injuries caused by a sidewalk defect they failed to repair — the main exemption is owner-occupied 1-, 2-, and 3-family homes used exclusively as a residence. DOT issues a Notice of Violation with 75 days to make the repair; miss that window and DOT can do the work itself and bill you directly, typically at a premium plus a 20% administrative fee.
